Company Order Policy

Returned Goods

Stock items are returnable up to 90 days from invoice date with a restock fee of 25% with no credit for shipping charges. Custom and special finish orders are non-returnable or refundable. Project work and large orders are subject to special terms. The goods must be accompanied with a RETURN GOODS AUTHORIZATION form in order to avoid loss of credit. Fax return requests to 212.760.3362 or e-mail orders@hamiltonsinkler.com. Failure to adhere to the guidelines set forth on the RGA may result in additional fees.

All returns will be credited only once goods are found to be in good resalable condition at the net value on the invoice, minus shipping charges, upon inspection. Defective goods will either be repaired or replaced within 30 days of receipt of defective goods. Defective goods must be accompanied with an RGA form and freight prepaid if not the fault of Hamilton Sinkler, otherwise a call-tag will be issued.

Cancellation & Revisions

Stock orders may be cancelled or revised prior to shipping by the customer. If the order has shipped, the customer is liable for all shipping charges.

Special Charges

The following are subject to an up-charge and/or an extended lead time:

  • Non-stock finishes

  • Special door configurations (i.e. large door thickness, non-stock backsets)

  • Custom orders

Custom Orders

Custom order requests are subject to acceptance by Hamilton Sinkler. Custom orders require a 50% non-refundable deposit prior to production. Balance amount is due prior to shipping. Custom orders may take longer than the stated period due to complexities in design and manufacturing.

 

Limited Warranty

This Warranty is for all hardware products (hereinafter “Product”) sold by Hamilton Sinkler, in the Continental United States, Hawaii, and Alaska, and is only valid upon presentation of bill of sale setting forth the date of purchase and amount paid for the Product.

Period of Coverage

The Product is warranted against defects in materials and workmanship under ordinary use for one year from the date of original purchase.

What This Warranty Covers

This Warranty applies only to Product that has not been subject to accident, misuse, neglect, fire or other external causes, unauthorized use, alterations, tampering, impact damage, or un-authorized repair. Excluding the causes above, this warranty covers the following:

  • Defects in materials or workmanship.

  • Incorrect function of the Product as defined by the hardware schedule or sales order.

  • Mechanical failure of the Product and its intended function.

What This Warranty Does Not Cover

  • This Warranty does not cover discoloration, oxidation or natural weathering of patinas or unprotected finishes.

  • Products used with parts not sold and provided by Hamilton Sinkler.

  • Any products or parts that have been incorrectly installed.

  • Products that are misused or damaged in the course of installation.

  • Products used other than for their designed use and function.

What We Will Do to Correct Problems

During this warranty period, if a covered defect arises in the Product, and you follow the instructions for returning the Product, we will, at our discretion, (i) repair the Product using either new or refurbished parts, (ii) replace the Product with a new or refurbished Product, or (iii) refund the purchase price of the Product to the place of purchase. This limited warranty applies to any repair, replacement part, or Product replacement for the remainder of the original warranty period or for ninety days, whichever period is longer. All replaced parts and Products for which a refund is given shall become our property.

What We Will Not Do

  • We will not pay for any labor costs used to remove or re-install the product.

  • We will not pay for or any freight, handling, or other charges related to shipping of the product to our location.

How to Make a Claim

While the Product is under the term of this warranty, if you have a claim, please call Hamilton Sinkler toll-free at 866-900-3326 or email orders@hamiltonsinkler.com and you will be advised of any or all of the following.

  • Dispatch of inspection agent.

  • Return Goods Authorization.

Limitations

To the extent permitted by law, the warranty and remedies set forth above are exclusive and in lieu of all other warranties and remedies, and we specifically disclaim all statutory or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose and against hidden or latent defects. If we cannot lawfully disclaim statutory or implied warranties, then to the extent permitted by law, all such warranties shall be limited in duration to the duration of this express limited warranty and to repair or replacement service as determined by us in our sole discretion. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

We are not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or under any other legal theory. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion or limitation may not apply to you.

This limited warranty gives you specific legal rights, and you may have other rights which vary from state to state.
